Due to some legal technicalities, legal sports gambling in New Mexico is a bit out of the ordinary when compared to other states. So, the question is: Is sports betting legal in New Mexico after the PASPA was overturned?

Well, it depends on who you ask. Many in the statehouse are saying, “No.” However, the Santa Ana Star Casino and Hotel in Bernalillo disagrees and has been offering sports wagers since October 16, 2018.

Everywhere else in the state, sports gambling remains illegal.

Statewide Brick and Mortar Sportsbooks

As mentioned, the Santa Ana Star Casino and Hotel in Bernalillo is the only brick and mortar sportsbook operating in New Mexico. They are able to do so because of the language in state law.

In New Mexico, sports gambling is considered a Class III form of gambling like blackjack or craps. State law says Class III gambling is only allowed at Tribal Casinos.

When the PASPA was overturned, The Santa Ana Star saw their opportunity and took it. There are 17 other Tribal Casinos operating in the state, but no others have begun to offer sports gambling.
